Can Student Loans Be Discharged in Bankruptcy? What About Child Support Debts? Alimony?
I am back folks. But, I have to admit that this will be a short one. I am in Tucson today for a 341 hearing, which means about 5 hours of commuting. Ah well, it a beautiful day and a scenic drive through the desert – things could be worse.
A majority of my clients come into their initial free bankruptcy consultation with some misconceptions about what bankruptcy can do for them. We all know bankruptcy has is benefits. It can eliminate credit card debt, stop creditor harassment, prevent foreclosure or repossession – and maaaaany mooooore (my favorite part of the birthday song, by the way.)
However, there are some cases where bankruptcy cannot help you eliminate their debt. What? You would like an example? Well, student loans fall into that category – most student loans cannot be discharged in bankruptcy. Domestic and child support obligations too. Certain tax debts also pass through bankruptcy intact, but that one is a little more complicated.

Certain types of debt, such as child support, alimony, and most student loans, cannot be discharged in bankruptcy. Wrongful conduct may make some debts non-dischargeable. Examples of such conduct are incurring credit card charges without the intent or ability to repay, or obtaining loans using false financial information.

Helpful info. You said “most student loans” are not dischargeable. I would like to know when a student loan is dischargeable. Would you be willing to write a post on that?
